Terms of Service

1. Acceptance of Terms
By accessing or using RIRWEB Accessibility Manager (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Services
RIRWEB provides website and document accessibility auditing, inventory, monitoring, remediation workflow support, reporting, and related professional services. Features may include WordPress connections, client portals, electronic proposals, and limited free scans.
3. Accessibility Auditing
Audits evaluate selected websites and documents using automated checks, document analysis, and, where recorded, manual review. Scope is defined in the applicable proposal, report, or project record.
4. Automated Testing Limitations
Automated testing cannot identify every accessibility barrier. Passing automated checks does not mean every accessibility requirement has been manually verified. Results are operational findings, not a certification of legal compliance.
5. User Accounts
You are responsible for maintaining the confidentiality of administrator credentials and for activity under your account. Notify RIRWEB promptly of unauthorized access.
6. Website Connections
You represent that you are authorized to connect the website and to permit RIRWEB to access the Media Library and related document metadata for the agreed services.
7. WordPress Connector
The RIRWEB Accessibility Connector is the recommended WordPress connection method. It uses one-time pairing and request signing. Application Passwords remain an alternative. The connector is read-only by default. Write operations, if any, are limited to specifically designed document replacement features that you enable.
8. Authorized Use
You may use the Service only for lawful purposes and only for websites and documents you are authorized to manage.
9. Customer Content
You retain rights in your websites, documents, and other content. You grant RIRWEB a limited license to process that content solely to provide the Service.
10. Document Processing
Documents may be inventoried, downloaded, analyzed, stored, and, when authorized, replaced. Checksums and metadata may be retained to detect duplicates and changes.
11. Electronic Proposals and Signatures
When a user electronically accepts a proposal through the Service, the Service may record information associated with the acceptance, including the proposal version, signer information, date and time, and technical information used to maintain an audit record. Typed or drawn signatures indicate intent to accept the locked proposal version. These Terms do not provide legal advice about enforceability in a particular jurisdiction.
12. Fees and Paid Services
Fees are described in proposals, invoices, or an agreed statement of work. Unless otherwise stated, work begins after acceptance and any required deposit.
13. Free Accessibility Scans
Free scans sample a limited set of public pages and documents. They are snapshots, not complete audits, and may be rate-limited.
14. Intellectual Property
The Service, software, documentation, and RIRWEB trademarks remain the property of RIRWEB. Reports and deliverables prepared for a customer may be used by that customer for internal accessibility planning.
15. Data and Privacy
Personal information is handled as described in the Privacy Policy.
16. Security
RIRWEB implements reasonable administrative and technical measures appropriate to the Service. No method of transmission or storage is completely secure.
17. Third-Party Services
The Service may depend on hosting, email, payment, or scanning providers. RIRWEB is not responsible for third-party outages or policies beyond its reasonable control.
18. Availability
The Service is provided on an as-available basis. Scheduled or unscheduled interruptions may occur.
19. Prohibited Use
You may not probe non-public networks, attempt unauthorized access, reverse engineer the Service except as permitted by law, or use scans to harass or attack others.
20. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS." RIRWEB DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW. RIRWEB DOES NOT WARRANT THAT A WEBSITE OR DOCUMENT IS COMPLIANT WITH ANY LAW.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIRWEB IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. RIRWEB'S TOTAL LIABILITY ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS PAID TO RIRWEB FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE CLAIM.
22. Indemnification
You will defend and indemnify RIRWEB against claims arising from your content, your websites, or your misuse of the Service, except to the extent caused by RIRWEB's willful misconduct.
23. Termination
Either party may terminate accounts or projects as provided in an applicable agreement. Upon termination, RIRWEB may disable connections and retain records as required for legal, accounting, or security purposes.
24. Changes to Terms
RIRWEB may publish updated Terms. Material updates receive a new version and effective date. Continued use after the effective date constitutes acceptance of the updated Terms where permitted by law.
25. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, unless a signed agreement states otherwise.
